PAYMENT TERMS. Net 30 days from receipt on open account, subject to approval. Visa, MasterCard and American Express are also accepted. Domestic credit card orders will be charged a 2.8% processing fee. International credit card orders will be charged a 4.0% processing fee. All prices quoted and monies due are in U.S. dollars.

MINIMUM ORDER: The minimum order amount is $25.00

DELIVERY AND SHIPMENT. All shipments are F.O.B. Loveland, Colorado. Buyer shall pay all shipping costs. Injectech, LLC will make every effort to meet the Buyer’s delivery date. Injectech, LLC is not liable for any losses or damages resulting from delays in delivery, manufacturing issues, acts of God or third parties, or other causes beyond our reasonable control.

INSPECTION/ACCEPTANCE OF PRODUCTS. Buyer shall be responsible for inspecting all products prior to acceptance. If the products are rejected, Injectech, LLC must receive written notice within 30 days of delivery, otherwise, the products shall be deemed to have been accepted by the buyer.

WARRANTY. Injectech, LLC warrants that products manufactured conform to the specifications for such product and are manufactured from controlled material lots. Injectech, LLC, must receive all warranty claims no later than 3 months from the date of shipment. The Injectech, LLC warranty shall not apply if:
1. Product is altered or modified in Buyer’s manufacturing or assembly process.
2. Any repairs or alterations have been performed by Buyer without prior notification and authorization to Injectech, LLC.
3. Negligence, misuse, or abuse of the product by any party.
This warranty does not extend to products or damages caused by purchased components, parts or supplies not manufactured by Injectech, LLC.

FORCE MAJUERE. Injectech, LLC shall not be liable for any delays in the delivery of orders, directly or indirectly, to fire, act of God, strike, shortage of raw materials, supplies or components, retooling, upgrading of technology, delays of carriers, embargo, government order or directive, or any other circumstance beyond Injectech, LLC’s control.

CANCELLED ORDERS. Cancellations of custom orders are subject to a cancellation fee based upon the amount of design, development and manufacturing at the time of cancellation.

RETURNED GOODS. A return authorization must be obtained from Injectech, LLC for products that do not conform to our warranty statement. Injectech, LLC does not allow returns in regards to changes to specifications, customer errors, or shipping schedules once the product has been shipped.

INDEMNIFICATION. Buyer shall indemnify and hold harmless Injectech, LLC from all losses, claims, damages, expenses or liabilities of any kind (including attorney’s fees and court costs) resulting from or arising out of any use by Buyer of products.

LIMITATIONS ON LIABILITY. Injectech, LLC shall not be liable for any loss or damage caused by delay in furnishing product. Under no circumstance shall Injectech, LLC be liable for any indirect, consequential, collateral, special, punitive, treble, exemplary or incidental damages (including, without limitation, loss of profits or goodwill) whether such claim is based on contract, negligence, tort, warranty or any other basis under or as a result of this contract or the products, irrespective of whether Injectech, LLC has been advised of the possibility of any such loss or damage. In no event shall Injectech LLC’s aggregate liability under or as a result of this contract exceed the total amounts actually paid by Buyer for the products purchased.

RESOLUTION. The laws of the State of Colorado shall govern all transactions and agreements. Any action in law shall be litigated in Denver, Colorado.
